Notice of Intent to Hire (LCA Notices)

Effective immediately, the International Center is making a change to its procedures relating to Tufts University's compliance with certain regulations pertaining to the H-1B temporary worker in a specialty occupation visa classification.*

Under Department of Labor regulations at 20 CFR 655.734, Tufts is required to give public notice to affected US workers of its intent to hire a nonimmigrant under the H-1B visa classification. The notice must include details regarding the terms of employment, but does not contain personal identifying information. The notice also provides US workers with information about their rights to examine certain documents, as well as to file complaints with the Department of Labor in the event they believe violations have taken place. Information in the notice are reflected in the Labor Condition Application (LCA) submitted to the Department of Labor prior to seeking H-1B authorization for a nonimmigrant employee.

Traditionally, Tufts University has relied on a hard copy notice method, whereby paper notices are posted for a minimum of ten days at two conspicuous locations in the nonimmigrant employee's place of employment. Moving forward, the International Center will be transitioning to an electronic method of posting. All LCA Notices will be publicly available at https://icenter.tufts.edu/immigration/lca. Electronic notices will be available for a minimum of ten days.

US workers may request inspection of public files connected to the LCA notice by contacting the International Center at internationalcenter@tufts.edu. Public inspection files are maintained at either the Medford or Boston offices of the International Center.
